A MAN was acquitted of a nine-year-old murder charge yesterday after the prosecution, following its statement to the jury, closed its case without offering any evidence.
Lemuel Mortimer was then unanimously acquitted of the charge by the 12-member jury that was empanelled.
He was charged with the March 25, 2004 shooting death of Jason “Fathead” Bain at Kemp Road.
However, in his reported statement to police, the shooting death of Bain was accidental.
Darnell Dorsett, who represented the Crown with Uel Johnson and public prosecutions director Vinette Graham-Allen noted this during her brief remarks to the jury before closing the case without offering any evidence.
 Neither the DPP nor Mortimer’s defending attorney Dorsey McPhee would comment about the matter for the record.
The Tribune, however, understands that the Crown had no witnesses or evidence to refute the accident to prove that Bain was murdered.
Mortimer, who was on bail after spending a number of years on remand, was discharged and freed.
