NATIONAL Insurance Board director Algernon Cargill has been granted permission to argue before the Supreme Court that former NIB chairman Greg Moss should be imprisoned for contempt of court.
The matter is set to be heard on Monday, February 4, according to documents filed with the court.
On January 10, Chief Justice Sir Michael Barnett said Mr Cargill and his lawyer are “at liberty to make an application to this court for an order of committal to prison of the second defendant and respondent, Gregory K Moss”.
The order, which follows the filing of an affidavit by Mr Cargill, is the latest twist in the long-running affair.
Early this month, Gregory Moss was fired by the Prime Minister from his post as NIB chairman.
Algernon Cargill was previously suspended from his post as director following claims by Moss and NIB about his actions.
Mr Cargill sued both Moss and the NIB over those allegations, claiming defamation.
The basis of the claim of contempt is that Moss failed to obey a court order filed on December 19 forbidding him to publish the words that became the basis of the defamation claim that originally featured in an email of September 18 from Mr Moss and in a letter dated November 8, signed by Mr Moss.
Mr Cargill says that those words were included again in a press release issued by Mr Moss. The press release from Mr Moss also criticised the Prime Minister and the Minister for NIB, Shane Gibson, for failing to speak out in his defence.

No worries sir, Moss is going down and you will be ruigjht there on top as usual. You cannot keep a good man down!
