PROSECUTORS in a high-profile murder retrial claimed that there was “no merit” in the constitutional motion made by a defendant accused with others of murdering an off-duty policeman.
The prosecution responded yesterday to arguments made by an attorney on behalf of Stephen ‘Die’ Stubbs, who along with Andrew ‘Yogi’ Davis and Clint ‘Russ’ Evans, faces a charge of murder concerning the March 13, 1999, shooting of Corporal Jimmy Ambrose.
On Tuesday, Mr Roberts, one of Stubbs’s attorneys, made a constitutional motion to Justice Roy Jones who is presiding over the case.
Mr Roberts presented authority cases concerning judgements on matters being retried after an “unreasonable” delay. The prosecution’s response to this yesterday was that the application had “no merit”. Justice Jones’s ruling is due on Friday, May 24.
