JUST months after taking up the post of Bahamas Bar Association president, Elsworth Johnson is facing an attempt by one of its members to have him committed to prison for contempt.
The BBA member said that in a week’s time, he intends to make such an application to the Supreme Court in connection with Mr Johnson’s alleged failure to produce certain documents despite a court order.
The member, who wishes not to be named, was granted leave by Senior Justice Jon Isaacs to make the application, which will be heard on December 5.
The Tribune understands that the dispute stems from a request, rejected by the Bar Association, to issue a certificate of good standing for the member and a form that concerns his membership dues.
When contacted for comment, Mr Johnson, who was elected this summer, said the matter is before the court and he would therefore reserve his comments until after the case is completed.
A hearing was scheduled before Senior Justice Isaacs on November 4 in which the member’s lawyer, Terrel Butler, sought to start an action on her client’s behalf to get the items which the judge ruled he should receive.
However, a representative for the BBA was not present at the hearing which resulted in the court granting leave for the Bar member to apply to the court to have the president of BBA be held in contempt.
The hearing of that application is scheduled for December 5.
