Suspect granted bail in rape case

A 49-year-old man accused of the statutory rape of a 13-year-old girl was granted bail in the Supreme Court yesterday with a warning that he was not to contact the teenager or interfere in any way with her or the witnesses. His trial was tentatively set for December 10.

Joseph Andrew Foulkes, of Yamacraw Hill Road, son of Governor General Sir Arthur Foulkes, was granted a $9,500 bail bond by Justice Vera Watkins on condition that

two suretors sign his bail and he reports to the police station every week.

Three weeks ago, Foulkes was arraigned before Chief Magistrate Joyanne Ferguson-Pratt on a charge of unlawful sexual intercourse, an indictable offence to which he was not required to plead. He is claimed to have had intercourse with the teenager between April and May 2012.

He is accused of a statutory rape because in law a 13-year-old cannot give consent.

Foulkes, who was on police bail before his arraignment, had been remanded to Her Majesty’s Prison, Fox Hill, until completion of his trial. At his arraignment, he was told that if he wanted bail, he would have to appeal to the Supreme Court.

Roger Gomez II represented him in yesterday’s bail hearing. He was represented by lawyer Heather Hunt for his arraignment.
