No fast track for Palm Cay killing case

TWO men recently charged in connection with a fatal shooting at the exclusive Palm Cay community in eastern New Providence did not have their case fast-tracked to the Supreme Court yesterday.

Dwayne and Samuel Heastie, and their lawyer Krysta Mason-Smith, appeared before Chief Magistrate Joyann Ferguson-Pratt for the scheduled presentation of a voluntary bill of indictment (VBI) in their case concerning the September 18 murder of Jean Richmond.

The indictment is a bundle of documents containing the Crown’s case against the brothers and facilitates the transfer of the case from the Magistrate’s Court to the Supreme Court.

However, no prosecutor from the Office of the Attorney General appeared for the VBI hearing.

The proceeding was adjourned to today after an indication from police prosecutor ASP Clifford Daxon that the indictment would be available soon.

On September 21, the Heasties were charged with murder, possession of an unlicensed shotgun and possession of ammunition.

It is alleged that the pair, concerned together, intentionally caused the death of Richmond.

It is further alleged that they were in possession of an unlicensed 12-gauge shotgun and six shotgun shells for the weapon, neither of which were they legally authorised to possess.

They will not be allowed to enter a plea to the charge until they are formally arraigned in the Supreme Court.

They are currently on remand at the Department of Correctional Services.

According to initial police reports, shortly after 11.30am on the day in question, two men were involved in an argument at the exclusive community off Yamacraw Road that resulted in one being shot with a shotgun.

Richmond died at the scene after being shot in the head.
