Man cleared as alleged victim withdraws complaint

A MAN was cleared of attempted murder charges yesterday when the alleged victim opted not to continue with his complaint.

Omar Chisholm and his lawyer, Krista Mason-Smith, appeared before Justice Bernard Turner for the start of Chisholm’s trial on two counts of attempted murder stemming from a shooting incident in October 2011.

Prosecutors alleged that the 36-year-old accused was the gunman who pursued and shot Kevin Johnson and Franky Pierre on October 26, 2011 near an Esso Service Station on East Bay Street.

Chisholm pleaded not guilty to the charges when formally arraigned in the Supreme Court in September 2012.

His April 7, 2014 trial did not proceed as scheduled and the case was adjourned to September 14, 2015.

Though the jury was empanelled, trial did not begin on Monday and was adjourned to yesterday.

In yesterday’s proceedings, Mr Johnson no longer wished to pursue his complaint and the jury was directed to return a not guilty verdict with respect to him as the Crown offered no further evidence concerning the complaint.

The other alleged victim in the case, Mr Pierre, could not be found to give evidence and prosecutor Linda Evans presented a nolle prosequi to the judge asking for a discontinuation of the proceedings.

A document was handed over to Justice Turner and Ms Mason-Smith with the authorisation of the Attorney General.

Chisholm had no other pending matters requiring him to remain at the Department of Correctional Services.
