A MAN will have to wait another week before he learns whether he will be released on bail beofe his trial on a murder charge.
Kyle Newbold, 24, appeared before Senior Justice Stephen Isaacs yesterday for the status of his bail application that had been sent back to the Supreme Court registry because the former (Acting) Justice Joyanne Ferguson-Pratt returned to the Magistrate’s Court.
Dr Heastings Johnson of the Department of Correctional Services was expected to testify as to the prison’s ability to provide adequate treatment for Newbold who has an existing medical condition.
However, the judge was reinstated as chief magistrate at the Nassau and South Streets complex before the matter could be heard.
Senior Justice Isaacs, yesterday, set the hearing for November 23 before Justice Cheryl Grant-Thompson as she will be the presiding judge over Newbold’s trial for the August 23 slaying of Martin Nixon.
Newbold and co-accused 22-year-old Christopher McQueen pleaded not guilty to murder when they were formally charged before Justice Bernard Turner on November 4.
According to initial police reports, shortly after 11pm off Blue Hill Road South, Nixon was involved in an argument with another man in front of a home when he was shot.
He was rushed to the hospital, but died of his injuries early the next morning.
When Newbold and McQueen’s case was transferred to the Supreme Court for trial in October, they were informed about the Voluntary Bill of Indictment and their right to enter an alibi in court or to the Office of the Attorney General in 21 days. Both men chose the latter option.
Newbold is represented by attorney Krysta Mason-Smith and McQueen by attorney Glendon Rolle.
