A 27-year-old man who threw a rock into a woman’s window when she refused to have sex with him was yesterday ordered to compensate her for her damaged property.
Dwayne Kelly was accused of causing $683.76 worth of damage to a woman’s dresser mirror and colonial window on October 13.
He pleaded guilty to one count of damage during a hearing before Deputy Chief Magistrate Andrew Forbes yesterday.
The court was told that around 10.30 that night, the complainant was at her mother’s residence on East Street sitting down with Kelly under a tree. The prosecution said the accused started to beg the woman for sex, but when she refused he became angry. The court was told Kelly then picked up two large rocks and threw them through the complainant’s window which caused damage to her window and bureau. As a result of the damage, the woman filed an official complaint with police. Kelly was arrested a short time later. In an interview with officers at a nearby station, he admitted to the offence.
When given an opportunity to speak during the hearing, Kelly told the magistrate his actions were not “intentional”.
Still, Magistrate Forbes told him if he knew something he did was going to create a consequence, that fact alone proved his actions were deliberate. He also asked Kelly why he would choose to engage in risky activities when he was currently on bail after appealing a murder conviction. He told Kelly next time, he should “think before throwing rocks”.
Magistrate Forbes accepted the accused’s guilty plea and ordered him to compensate the complainant $683.76 for the damage. He warned Kelly if he failed to do so, he would spend two months at the Bahamas Department of Correctional Services.
Yesterday, Kelly was also accused of assaulting the woman and violating the curfew after police found him on East Street after 8 o’clock on the night in question.
He denied those charges and his case was adjourned to December 15 for trial. He was granted $1,000 bail in the interim.
