Released after vagrancy charge

A MAN who spent three months on remand after being arrested for vagrancy last year has been released from custody.

Cenario Cunningham, 33, appeared before Magistrate Kendra Kelly on charges of vagrancy after being arrested for living in the area around Liquid Courage off West Bay Street.

After his arrest in November 2021, Cunningham spent the past three months in custody and underwent psychiatric evaluation at Sandilands Rehabilitation Centre.

In court, Magistrate Kelly noted Cunningham looked more composed and “clearer” than his previous court appearance. She asked if had received any medication since his last court date, however he said he had not. The magistrate is still awaiting his official psychiatric report.

Police prosecutor Vernon Pyfrom noted in court that Cunningham had already served three months on remand with the maximum sentence for his charges being four months. As such he suggested Magistrate Kelly withdraw Cunningham’s case.

The magistrate elected to have all charges against Cunningham withdrawn, resulting in him being acquitted and discharged from custody.
