Discharge in drugs case

A Magistrate’s Court yesterday placed a man, accused of drugs, on conditional discharge.

Henry Fowler Jr, 32, appeared before Magistrate Shaka Serville on a charge of possession of dangerous drugs with intent to supply

On June 14, Fowler was arrested after he was found with one and a quarter ounces of indian hemp in several silver foil wrappings. The drugs have an estimated street value of $75.

In view of the relatively small quantity of drugs found with the accused, on the advice of the prosecutor, the magistrate reduced the charges to simple possession. Fowler pleaded guilty.

Fowler then explained that the drugs were for his personal use and that he has been a smoker for 16 years. The accused further said he has three stepchildren to provide for and that he just wants to put this situation behind him.

Because the accused indicated he was willing to find alternatives to his smoking habit, Magistrate Serville placed him on a conditional discharge.

Fowler is expected to attend CCAC for drug counseling courses. If, at the end of the six-month course, Fowler returns to court with a satisfactory report, he will be granted an absolute discharge.

However, defaulting on these conditions would result in the accused receiving a $500 fine and the charge remaining on his record.

Fowler is expected to return to court for a report on December 7.
