A WOMAN who was accused of causing damage and making death threats against her ex’s wife alleged she only committed the acts because she was a victim of an acid attack at the hands of the complainants.
Shacoya Davis, 34, appeared before Senior Magistrate Samuel McKinney on two counts of making threats of death and a separate charge of causing damage. This comes after Davis allegedly made threats against Christovia Lunn-Butler sometime between January 2021 – May 2021 and again on December 8, 2021.
Davis is accused of threatening her romantic rival Mrs Lunn-Butler by saying she would kill her anytime she caught Mrs Lunn-Butler walking her dog and would also “shoot up her house”.
Davis was also charged with causing damage to her ex and Mrs Lunn-Butler’s husband Chico Butler’s car.
The court was told on February 28, 2022, while at AG Electrics, the accused intentionally damaged the front driver’s side door window of a pink 2012 Honda Life with a pickaxe. The total value of damage to the vehicle was $300.
In court, Davis pleaded guilty to all charges against her, but explained that she only acted this way after her ex, Mr Butler, and his wife allegedly threw acid at her. Davis further explained that her actions were largely reactionary to the months she claimed she was harassed by the Butlers.
Tamara Taylor-Storr, Davis’s attorney, gave additional context to her client’s situation by saying that since having acid splashed in her face and hands allegedly by the complainants, Davis has been facially disfigured and is still seeking treatment.
She said that Davis’ behaviour was the culmination of months of frustration after being continually harassed over the phone by the complainants. Ms Taylor-Storr also expressed her client’s feelings that no justice had been carried out in relation to the attack, due to the court saying there was a lack of sufficient evidence to pursue charges.
While Davis had an assault charge in the past, Ms Taylor-Storr implored the court to have mercy on her client as she said that her client was the victim in all of this. She further said that Davis is remorseful for her actions and is a single self-employed mother.
She asked the court not to impose a custodial sentence on her client.
Magistrate McKinney ordered Davis to pay the court $300 on the causing damage charge or spend one month in prison. The magistrate also placed Davis on 18 months probation for the threats of death charge. If she breaches probation, she could face a fine of $1,500 or six months in prison.
Magistrate McKinney warned Davis not to come into contact with the virtual complainants. If she does she will risk a $300 fine or six months behind bars.
At the end of her trial both Davis and her attorney stated their intention of pursuing charges for the alleged acid attack.
