The Wicked Witch praises the Chinese general contractor while making derogatory remarks about Sarkis Izmirlian every chance she gets. She maliciously claims Sarkis has sullied the reputation of the Bahamas but most Bahamians know that no one has ever or will ever besmirch our country and embarrass us more than Maynard-Gibson. This scornful and spiteful woman exudes almost as much evil as the devil himself.

Well_mudda_take_sic 9 years, 4 months ago on Baha Mar’s Chapter 11 filing ‘severely flawed’

WELL WORTH REPEATING: Our government never told Baha Mar and Sarkis Irzmirlian at the inception of the project, nor at any time before Baha Mar's Chapter 11 bankruptcy protection filing in Delaware and legal actions filed in the High Court in the UK, that Baha Mar would not be able to avail itself of laws in jurisdictions other than the Bahamas as a means of remedying major disputes that might arise during the development. If the agreements signed by Baha Mar with the Bahamian government and the Chinese enterprises concerned do not limit Baha Mar to seeking legal redress in the Bahamian courts for the claims relating to its grievances and its financial/liquidity needs attributable to those grievances, then the Christie-led PLP government is patently wrong in its application that Baha Mar be placed in liquidation by the Bahamian courts. Absent a limiting contractual undertaking, choosing the best jurisdiction for legal proceedings that must be initiated is a fundamental right of any private sector enterprise like Baha Mar. For the Bahamian government to now suggest, at this late stage of the development, that the project is a de facto public sector enterprise by virtue of being too large too fail, and therefore all legal proceedings relating to it must be brought before the Bahamian courts, is patently wrong and most harmful to the developer. As for the large sums currently owing by Baha Mar to the Bahamian government, the mere fact that the Bahamian government allowed these sums to become so large is prima facie evidence that the government was only too willing to extend significant sums of credit to Baha Mar to help out with the project's liquidity needs. In fact, it is generally well known that the Bahamian government has a well established history (rightly or wrongly) of extending very large amounts of credit to foreign developers. It is therefore a great travesty for the the Christie-led PLP government to now turn around and attempt in a most unjust way to pull the rug out from under Baha Mar. The behaviour of the Christie-led PLP government in this matter wreaks of vindictiveness and malicious intent, deviously masked by the pretense of concern for the sovereignty of the Bahamas. We can only hope that the impending ruling of Justice Winder will be seen as a most important step towards restoring the faith of the Bahamian people and the global community in the independence of our judicial system. We have a Constitution that expressly does not permit the "nationalisation" of privately owned assets by any means!

No matter what government says, this most certainly is going to be seen as the government of The Bahamas siding with the Chinese and stealing a private business from it's principle. Who in the hell would invest in a country where that can happen to your investment? These guys are playing a very dangerous game and The Bahamas as a whole stands to lose much more than just Bah Mar. Get this straight in your heads, they get rid of Izzy, they sink the nation. Cuba must be very happy just about now.

The international community is not stupid. They will see this for what it is, the Bahamas government puppet (our court system) doing their bidding. Any fool that says our court system is independent can look at the many instances where government has influenced the judicial process. A certain numbers mans case just recently reeks of political direction. These corrupt politicians think they are fooling everyone when in reality they are only fooling themselves. FDI is a thing of the past unless it comes from China. Also how come it was fine for Atlantis to go into bankruptcy in Delaware but not Baha Mar? What is the big difference, the government has been directed by our new masters!

Our government has not and does not represent the best interests of the people of the Bahamas and hasn't done so for some time. Bahamians better wise up fast because the PLP are charging towards the shoals and will put us all on the rocks.

Where do we go to hand in our Bahamian passports? I am ashamed to be the holder of one now.

The silver lining in this is that the corruption within the PLP will most likely come out. The AG will certainly not investigate any claims of corruption but the U.S. and Britain surely will. The PLP are digging their own grave and the grave is deep and wide.

That's exactly what I'm suggesting.

Look...... I'm no big fan of HAI and the FNM party either. But the man knows how to conduct business, get things done, and establish infrastructure. If the FNM were in power, the airport would be complete, as well as other major projects such as Baha Mar. The FNM brought in Sun International which developed and completed the mega resort Atlantis, and amidst major controversy, also completed an island-wide road works project! They are NOT a perfect government........ but they know how to get major projects done!! The FNM's problem is....... they seem to blatantly neglect the IMMEDIATE needs of the people! In other words, "people can't eat new roads or new buildings."

HAI is a stubborn, bull headed, ego maniac who only seemed fixated on his ideas! But the man knows how to get things done! If the FNM were in power Baha Mar would have been completed and thousands of Bahamians would have had jobs. Furthermore, (unlike PGC) HAI is respected amongst global leaders!

Again...... HAI gets on my nerves sometimes too!! But he is a much better leader than Perry! Voting for Perry and the PLP has caused our country to regress and recede! We have taken ten steps backwards under the PLP!! We should have bitten the bullet under HAI until we established another party willing and able to lead us into the 21st century. And as you can tell.... it certainly ain't the PLP.

Ok so let's say we accept the ruling that the Judge denied the chapter 11 bankruptcy recognition because he wanted the matter to remain in the Bahamas jurisdiction and under the administration of Bahamian courts. So what is the purpose of denying Izmirilian any protection from his creditors and a chance to reorganize his assets? From what we know the project fell into financial problems because the China Construction Company was more than six months behind on completing its work and the China bank refused to advance additional funds. This ruling tends to force Izmirilian out and gives little opportunity for him to recoup any of the funds he has invested in Bah Mar.

Its kinda right there in plain English in the doctor's report. He got shot in the back of the neck, end of story. They made up a story about him being shot in the face, presumably to cover it up.

This Bowe fella tells us to be free of emotion but he had plenty of emotion in supporting Christie's introduction of the harshly regressive VAT that is taking a dreadful toll on the poor in our country today. He's right about one thing though: “Liquidation in the Bahamas is essentially a stop and sale action....". The project has certainly been "stopped" and will now be "sold" to the Chinese for pennies on the dollar thanks to the mega-millions of dollars in losses the Bahamian government has forced the Izmirlian family to incur by the de facto "nationalization" of their circa US$800-900 million investment in the 97% complete Baha Mar development.

On point in as much as Baha Mar has never been technically insolvent under the insolvency laws of the Bahamas; the concessions granted have considerable value, upwards of the equivalent of US$1.2 billion, even by the admission in public of the Christie-led PLP government. A consolidated statement of financial position of the Baha Mar development prepared on a fair value basis immediately prior to the Bahamian government's announcement that it would petition for the liquidation of the project, would undoubtedly show that total assets exceeded total liabilities in which case Baha Mar was technically solvent. Much of this value was immediately destroyed though immediately upon the liquidation announcement by our government; and most of this destroyed value related to the Izmirlian family's equity stake in the project.

It may be a good idea for private individuals to have stakes in businesses but the government should keep their dirty hands off of them. They have proven time and again that they know nothing about running businesses.
