It seems like the judges who denies the accused person bail in the first instance should the one that the applicant as opposed to the prosecution has to convince that he or she should be granted bail. Being presented with a docket for a person in detention applying for bail and not being familiar with the person or the circumstances pertaining to the case and the denial of bail forehand ties a judges hands in the applicants favor.
