THE former administrator of the Elizabeth Estates Children’s Home, who was accused of sexually assaulting a 17-year-old girl in his care, is a free man after prosecutors dropped all charges against him yesterday.
Justice Renae McKay told Ray Nairn, 62, that his case would not proceed because the prosecution had entered a nolle prosequi, a formal notice that it will not continue with a case. The decision came before a jury had been empanelled to hear the matter.
Nairn had been charged with unlawful sexual intercourse with a dependent child, attempted unlawful sexual intercourse with a dependent child, cruelty to children and two counts of indecent assault.
Prosecutors had alleged that he inappropriately touched the teenager between January 1 and June 24, 2024, and that he exposed her to alcohol on January 12, 2024, causing her unnecessary suffering or injury to her health.
He was further accused of indecently assaulting her again on December 16, 2024, and of having and attempting to have unlawful sexual intercourse with her on the same date.
Nairn was first arraigned in December 2024 before Senior Magistrate Anishka Isaacs, when he was not required to enter pleas and was remanded in custody. He was told at the time that he would have to apply to the Supreme Court for bail.
The Elizabeth Estates Children’s Home was opened by the government in 1992 and cares for children who are referred by the Department of Social Services and the courts after being abused or neglected.
Ryan Eve represented Nairn. Calnan Kelly appeared for the prosecution.
